No, I had the super power first. It's pretty funny being the kid with a purple mohawk in a M65 woodland field jacket and Matterhorn boots at the 7-11 when there are 5 cops standing about chatting you up while your housemates are buying ramen, soda and chips and you have to be told to hurry up.
Funnier when after this happening, all of the cops know me by name, I know them by name, and get the wave off on most tickets.

Yeah I KNEW there had to be a 911 call out there. A woman got in touch with David after she saw everything in the press. She originally called 911 to
report an assault, then hung up when she realized it was the police, but not until Zack had been attacked from behind. I don't know if David needs the actual call; he did get her statement. I'm sure they could get the call if needed. |

I asked David about this Cleary investigator:

My guess is some accounts were only towards the end of the incident and he gave her the most thorough ones. I'm sure he'd hand over all of them if she wanted. |

To follow up on this, the lawyer also asked that this little nugget of information be publicized.

And a little more clarification from David:

More clarification - this is Janna, Zack's mom..
If at all possible, witnesses should have the statements they wrote up in front of them when they talk to the detective on the phone, just to keep refreshed and consistent.
Before you give a statement - which will be recorded over the phone and then transcribed - ask the detective to confirm that you will be given a copy of the transcript of the phone call for your reference. You want it for your reference. Period. Ask when you can pick it up so you can check it right away. If you have already given the detective a statement, call back and request a copy of the transcript of your statement for your reference. You are not asking for a copy of her report. You are asking for a copy of your own verbal transcribed statement. David says this shouldn't be a problem, that she will do this. Please let me or Jill know, or call David yourself if she is unwilling to give you a copy of the transcript of your recorded statement.
We want to cooperate with the investigation, give statements (basically re-stating what was in the written statements), show that we have nothing to hide and thus expedite the decision not to file charges.
The detective told David that "most people didn't see much... mostly bits and pieces toward the end.not the whole thing."
I read a bunch of the statements and David and I are puzzled because a bunch of you guys saw the whole thing or pretty close to it. So take her through the story very clearly step by step. Say what you saw, what you heard (well, lighten up on the fuck you's..).
If she's talked to you already and you did see what happened at the beginning, be sure to ask for a copy of your transcript right away and be sure that the beginning is there. It is important to have it documented that these guys started this as civilians and it was not known that they were cops and that they were big, scary, rough...

My housemate works for Metro and she told me that the sheriff's dept over spent thier budget so other parts of the county had to take cuts to make up the difference. Of course they're pissed, this may explane Sims remarks in the paper last weekend. RECALL SUE!!!! |

The prosecutor told David last week that they would need more time to go over the evidence. David met with them yesterday (Monday) and gave them more statements and they indicated that a decision should be made by the end of this week, most likely by Mr. King County Prosecuting Attorney, Norm Maleng.
Also, stay tuned for the front page of Wed's P-I. The P-I's investigative reporters who did the "Conduct Unbecoming" series this past spring have another installment. |

So did they decide to go ahead with the charges? I would love to be the fly on the wall at thier meetings...... It's a minor case, what could be taking so long? There has got to be some argument or some such in the prosicutors office. How can they go forward when the county exec is pulling the rug out from under the sheriff whith statments to the media? Just some idle speculation on a hot Friday night.
Those with media contacts should invite them to Mass next week. |

No charges in cop vs. bicyclist case
P-I STAFF
Arrested in June for allegedly assaulting an undercover King County sheriff's deputy, a bicyclist won't be facing even misdemeanor charges for the fracas. The bicyclist, Zachary Treisman, was arrested June 30 for investigation of third-degree assault for the altercation with the deputies. Treisman was biking as part of the Critical Mass demonstration in which bicyclists ride through downtown Seattle as a show of support for bicyclists rights. The deputies were part of Metro Transit Police and were in an unmarked van when it was stopped by the mass of bikes downtown. When the deputies arrested one of the riders, Treisman tried to intervene. Treisman has said he did not know the men taking his friend to the ground were deputies until after he got involved. King County prosecutors have passed the case along to the Seattle City Attorney's Office, which this week also declined to file any charges. |

Great news to hear.
I was wainting in JFK Airport when I heard.
Now I'm in Cologne, trying to figure out what day it is and get moderately situated. Once my stuff has a home and I know where I'm sleeping, I'll have me a beer. The local flavor is Kolsch.
One great thing about travelling is the acceptance of bikes in cities. And the cars are appropriately small too. Deutsche Bahn has started a new program called call-a-bike. There are these big red and silver bikes around near the train station. The rear wheels have a lock, and the lock has a phone number. One calls the number and gets a code to unlock the bike. Brilliant!
Once again, thanks for all the help. It is good to be a free man. I think that the whining about the PI that the KCSD is doing is a sign that the pressure is being felt. There will be some changes coming out of this.
On the other hand, I'm reading a book called Maximum City about Mumbai/Bombay, and it makes me glad to live (for now) in a place where one can be reasonably secure that a trip to the police station will not result in torture... |

| I did a brief stint as a foreign exchange student in Bonn in the 80's. I drank quite a bit of Kolsch when I was there. Also, if you can get down there, I recommend the Bonn City Brewery. |
